ICANN vs EPAG: ICANN Seeks Appeal Plus Pushes for ECJ Referral

June 14, 2018 by Michele Neylon

As I predicted ICANN is pursuing its case against EPAG. They're now not only appealing the case to a higher court in Germany, but are also trying to get the entire thing referred to the European Court of Justice. In an announcement late last night ICANN made it very clear what their intentions are. While they're pursuing the appeal in the higher court in the German region, … [Read more...] about ICANN vs EPAG: ICANN Seeks Appeal Plus Pushes for ECJ Referral

ICANN vs Epag / Tucows: German Court Rules Against ICANN

May 31, 2018 by Michele Neylon

Last Friday ICANN took German registrar EPAG to court in Germany. German courts seem to be pretty fast, so instead of having to wait weeks or months to see how they'd rule, we've already got the answer. The German court in Bonn has ruled that EPAG (Tucows) is not obliged to collect extra contacts beyond the domain name registrant. The decision, naturally, is in German, … [Read more...] about ICANN vs Epag / Tucows: German Court Rules Against ICANN

ICANN vs EPAG / Tucows: Tucows Releases Statement on What They’re Doing and Why

May 29, 2018 by Michele Neylon

Tucows logo

As I noted over the weekend, ICANN has instigated legal action against Epag, an ICANN accredited registrar based in Germany that is part of the Tucows group. ICANN claims that the case is to "preserve WHOIS data", but Tucows asserts in their statement that the ICANN approach is flawed. It's not a frivolous statement, but one they've backed with fairly detailed rationale - … [Read more...] about ICANN vs EPAG / Tucows: Tucows Releases Statement on What They’re Doing and Why

ICANN Sues German Registrar Over GDPR

May 27, 2018 by Michele Neylon

ICANN announced Friday that it is pursuing legal action in Germany against Epag. Epag is owned by Tucows, who are one of the largest registrars in the world. So what is going on? Why is ICANN taking legal action against a registrar? According to the announcement from ICANN the action is "to preserve whois data". However it's not that simple. ICANN has been … [Read more...] about ICANN Sues German Registrar Over GDPR

The ASO, which represents the IP numbering community globally, recently completed its election cycle for the ICANN Board. I posted about the original slate of nominees a few months ago. Ron da Silva has been re-elected for a 3 year term which will start at ICANN's autumn meeting later this year. Full details on the election process within the ASO may be found here, with … [Read more...] about IP Numbers Community Re-Elects Da Silva to ICANN Board

ICANN Writes to ALL European Union Privacy Authorities

March 29, 2018 by Michele Neylon

Padlock over EU map symbolizing the EU General Data Protection Regulation or GDPR. Designed to harmonize data privacy laws across Europe.

In what could be viewed as an unprecedented move, ICANN has written to each and every data protection authority in the European Union. Why? ICANN feels that there is uncertainty about how the General Data Protection Regulation (GDPR) should impact registrars and registries specifically in relation to the collection, processing and retention of domain name registration … [Read more...] about ICANN Writes to ALL European Union Privacy Authorities

February 4, 2018 by Michele Neylon

ICANN Logo

As happens every year ICANN has put their budget and plans out for public comment. The organisation's overall budget has grown significantly over the last 10 years, as has the organisations staff headcount, number of offices and other aspects of its operations. However this year's budget is going to be quite different from those of previous years. Revenue is not growing … [Read more...] about ICANN Budget out for Comment

ICANN Maps Whois Models For GDPR

February 2, 2018 by Michele Neylon

ICANN GDPR model mapping

Earlier today ICANN held a webinar to provide an update on their data privacy activities in relation to whois and GDPR. Rather than simply talking about the various "models" they produced both a visual mapping as well as a matrix. While some attendees may not agree with how all the models are classified it is still a helpful way of showing the deviations from the current … [Read more...] about ICANN Maps Whois Models For GDPR
